Get basic services with the Essential tier, a full range of support services with the Enhanced tier, or get data views and proactive management with the first tier. 2.10.1 The Company undertakes to correct all errors in the software developed under this Agreement and which are communicated in writing by the Customer within 30 days of the date of acceptance, at the rates and terms of payment indicated herein. 9.1. Exemption by AVEVA. AVEVA defends, indemnifies and indemnifies the customer against claims of third parties who claim that the use of the products by the customer constitutes, in accordance with the terms of the agreement, an infringement or misappropriation of a patent, copyright or trade secret of a third party. AVEVA pays final damages to the third party (or the amount of a transaction that AVEVA enters into) in respect of these rights. AVEVA acknowledges, with respect to all personal data of the Customer processed in connection with THE PERFORMANCE BY AVEVA of its obligations arising from this Agreement: the Customer acknowledges and agrees that the explicit obligations and guarantees that the Company makes in this Agreement are, instead of and to the exclusion of any other warranties, conditions, durations, undertakings or warranties of any kind, expressly or implicitly, by law or by other means, with respect to all supplies or services provided under or in connection with this Agreement, including, but not limited to, any warranties of diligence, capacity, condition, quality, performance, affordability or fitness for professional services or any part thereof. . . .
